The Clinicians' Biosecurity Network (CBN) is a secure website that provides authoritative and timely information to clinicians who are interested in biodefense preparedness and response. A subscriber must accept the Terms of Use as a condition of using the website. If the Terms of Use are revised, changes will be posted promptly on our website and subscribers will be notified.

Indemnity

A subscriber agrees to defend, indemnify, and hold harmless The Network, its managers, operators, contributors, service providers, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, resulting from, or alleged to result from, a subscriber's use of The Network or breach of the Terms of Use.

Disclaimer, Denial of Warranty, Limitation of Liability

The Network consists of a website and, upon request, e-mail services that are provided as information resources for physicians and other professionally licensed health care providers who are interested in biodefense issues. The sole purpose of The Network is to allow the exchange and/or dissemination of information and/or opinions related to biodefense and certain emerging infectious diseases.

Information contained herein is not medical advice or a treatment guide for patient care, does not constitute a recommendation for or advice about medical treatment, and should not be relied upon for treatment decisions or patient management. While referring to information posted on and distributed through The Network, a subscriber understands and agrees that the individual clinician must use his/her best medical judgment in determining appropriate care or treatment for each patient. Subscribers are cautioned that The Network is not intended to provide patient-oriented medical advice about any specific medical condition they may have or treatment they may need, and they are urged to contact their physician, health care provider or a properly licensed medical practitioner in their jurisdiction promptly with any health related questions or concerns. No doctor-patient relationship is created through use of The Network. Subscribers should not delay in seeking medical attention based on information available on The Network.

As a condition of use, subscribers also understand that information herein may be inaccurate, incorrect or improper. While The Network makes every effort to ensure that information posted on and distributed through this website is timely and accurate, information and standards of care may change rapidly or prove controversial; therefore, The Network does not warrant the accuracy of material posted on this site and will not be held liable for errors, omissions, or inaccuracies. Subscribers agree to use their own judgment and independently investigate any information obtained from The Network. Information posted herein is not intended to be the sole source of information on any topic, subject, condition, treatment, or event, and any application or use of materials posted by The Network shall be at the sole risk of the user and based upon the subscriber's independent, and independently exercised judgment.

Information accessed though The Network is provided "as is" and without warranty, expressed or implied. Subscribers are hereby warned that the owners, operators and sponsors disclaim all warranties expressed or implied, including any warranty of merchantability or warranty of fitness for a particular purpose which may apply or be claimed to apply to any use of The Network, or any posting to The Network, or available through it. The University of Pittsburgh Medical Center, Center for Biosecurity, OmniTI Computer Consulting, Inc., network contributors, authors, editors, production staff, and other participants ("The Providers") shall not be held liable for errors, omissions, or inaccuracies in information of any kind, or for any damage or loss of any other kind involving clinician users, their patients, or other network users, whether direct, indirect, or consequential, arising from or caused by use of or reliance upon any information contained in or distributed through this website, even if the network host, managers, contributors, or other participants have been previously apprised of the possibility of such damage or loss.

The Providers cannot and do not guarantee or warrant that files available for downloading from The Network will be free of infection from viruses, worms, Trojan horses, or other code that may manifest contaminating or destructive properties.

Mention of specific products or drugs on The Network does not constitute endorsement by The Providers. Regarding specific products or drugs, physicians and other health care providers are advised to consult their normal resources before prescribing to their patients.

Jurisdiction

This Agreement shall be governed by the laws of the State of Maryland without regard to its conflict of laws rules. A subscriber expressly agrees that exclusive jurisdiction for any claim or dispute with The Network or its managers, operators, contributors, or service providers, resides in the courts of Maryland, and further consent and agree to personal jurisdiction by the state and federal courts sitting in the State of Maryland in connection with any such dispute.

Legality of Use

The Network makes no claims that its contents may be lawfully viewed or downloaded outside of the United States. Access to the website may not be legal by certain persons or in certain countries. If a user accesses the website from outside of the United States, they do so at their own risk and are responsible for compliance with the laws of their jurisdiction. These Terms of Use are governed by the internal substantive laws of Maryland without respect to its conflict of laws principles. Jurisdiction of any claims arising under these Terms of Use will lie exclusively with the state or federal courts within Maryland. If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision will not affect the validity of the remaining provisions of these Terms of Use, which will remain in full force and effect. No waiver of any provision of these Terms of Use will be deemed a further or continuing waiver of such provision or any other provision. Except as expressly provided in another statement by The Network on its website, these Terms of Use constitute the entire agreement between a subscriber and The Network with respect to the use of The Network website and e-mail service. No changes to these Terms of Use may be made except by a revised posting on this website.

Trademarks and Service Marks

Clinicians' Biosecurity Network is a service mark of the University of Pittsburgh Medical Center on behalf of the Center for Biosecurity. Its contents are provided by The Network to their users in good faith. As the principal purpose of The Network is for non-profit educational use, some or all of the content has been provided pursuant to the doctrine of "Fair Use" as that term is defined in United States copyright law. Users of The Network must also conform to the requirements of "Fair Use." Unauthorized use may violate copyright, trademark, service mark, or other laws. Users may not sell or modify The Network's contents without express permission of The Network. Users may not copy or adapt the HTML or other code that The Network uses to generate its pages.

Registration and Account Security

A subscriber must provide true, accurate, and current information in the registration form and should make every effort to maintain the registration information current in the event of changes.

Username and Password

As part of the registration process, a subscriber will create a user name and password, both of which should be kept confidential. The subscriber should promptly inform The Network of the need to deactivate a password.
